Terms Of Use

These Terms of Use ("Terms") govern the conditions for using the digital talent and casting services provided by [Platform] ("Platform"). The parties to this agreement are, on the one hand, Eysstalent, which operates the Platform ("Company"), and, on the other hand, the user who registers for or uses the Platform ("User", "You"). By registering for or using the Platform, you acknowledge that you have read, understood, and accepted these Terms. If you do not agree to these Terms, you must not use the Platform.

1. Scope of Services

The Platform is a talent-casting matching platform where talents (including actors, models, dancers, singers, voice actors, face models, and similar professionals) can create and showcase their profiles, while industry professionals and employers can discover and contact these talents. The Platform acts as an intermediary that provides communication and matching opportunities between users and is not a party to any agreements, contracts, or employment or business relationships between users.

2. User Account and Registration Requirements

  • You must be 18 years of age or older to register for the Platform.
  • You agree to provide accurate, current, and complete information during registration.
  • You are responsible for the security of your account and the confidentiality of your login credentials. You are responsible for all activities carried out through your account.
  • If you become aware of any unauthorized use of your account, you must notify us immediately.
  • Each individual may create an account only in their own name. Creating an account on behalf of another person or using false information is prohibited.

3. User Obligations

  • You agree to use the Platform only for lawful purposes and in accordance with these Terms.
  • You represent and warrant that all content you upload is accurate and does not infringe the rights of any third party.
  • You must refrain from conduct that may mislead, harass, or cause harm to other users.

4. Prohibited Conduct and Content

The following conduct and content are strictly prohibited:

  • Content that violates applicable laws, public morality, or public order, including obscene, violent, hateful, or illegal content.
  • Unauthorized use of another person's photographs, videos, identification documents, or personal information.
  • Creating fake profiles, concealing one's identity, or impersonating another person.
  • Sending unsolicited commercial communications (spam), engaging in fraud, or sharing misleading content.
  • Actions that compromise the security of the Platform, attempt to gain unauthorized access to systems, or disrupt the operation of the service.
  • Infringement of copyrights, trademarks, or other intellectual property rights.

5. Token System and Payments

Certain functions on the Platform, such as sending messages and applying to listings, require the use of tokens. The terms applicable to tokens are as follows:

  • Tokens are considered digital products and may only be used within the Platform. They cannot be converted into cash or transferred to another person or account.
  • Purchased tokens are excluded from the right of withdrawal pursuant to Article 15/1-a of the Turkish Distance Contracts Regulation (Mesafeli Sözleşmeler Yönetmeliği). Accordingly, NO REFUNDS WILL BE PROVIDED after the purchase of tokens. By confirming your purchase, you acknowledge and accept this condition before completing the transaction.
  • Payments are processed through iyzico (Türkiye) or Stripe (international), depending on your preference and the applicable payment method. Your card information is not stored by the Platform.
  • You are responsible for any applicable tax obligations, including VAT, and any invoicing obligations applicable to your individual circumstances.
  • Token packages, prices, and usage fees may be updated from time to time. Current information is displayed on the Platform.

6. Profile Content and Copyright

  • You retain the intellectual property rights in the photographs, videos, and other content you upload, or you represent and warrant that you have the necessary rights to use such content.
  • By uploading your content to the Platform, you grant the Company a non-exclusive, limited license to host, display, and make such content available to other users on the Platform solely for the purpose of providing the services.
  • We reserve the right to remove content that violates applicable laws or these Terms.

7. Messaging and Communication Rules

Messaging conducted through the Platform must be carried out with respect and honesty between users. Harassing, threatening, or unlawful messages are prohibited. Such content may be reported through the reporting mechanism, and where necessary, the content may be hidden or sanctions may be imposed on the relevant account.

8. Listings and Application Process

Employers may create listings, and talents may apply to these listings by spending tokens. Each application requires a separate token expenditure. The respective users are responsible for the content of listings and the evaluation of applications. The Company is not a party to the relationship between the listing provider and the applicant.

9. Announcement Board (Pinboard) Use

Notes posted on the announcement board are visible to all users and are subject to the content rules set forth in these Terms. Pinboard notes are automatically deleted 30 days after they are created.

10. Account Suspension and Termination

  • You may close your account at any time.
  • We reserve the right to suspend or terminate your account without prior notice in cases of violation of these Terms, unlawful use, or conduct that causes harm to other users or the Platform.
  • Termination of an account does not create an obligation to refund tokens that have previously been purchased or spent.

11. Limitation of Liability

The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, the Company is not responsible for communications, agreements, or business relationships between users, the accuracy of content shared by users, or uninterrupted or error-free operation of the service. To the maximum extent permitted by applicable law, the Company shall not be liable for indirect damages or loss of profits.

12. Force Majeure

The Company shall not be held liable for any failure or delay in fulfilling its obligations caused by events beyond the reasonable control of the parties, including natural disasters, fire, epidemics, war, cyberattacks, infrastructure or internet outages, or decisions of competent authorities.

13. Governing Law and Jurisdiction

These Terms shall be governed by the laws of the Republic of Türkiye. The courts and enforcement offices located in the jurisdiction where the Company's registered address is located shall have jurisdiction over disputes arising from these Terms. For users qualifying as consumers, the competent authorities and forums provided under applicable consumer protection legislation shall remain reserved.

14. Changes to the Terms

The Company reserves the right to modify these Terms from time to time. Material changes will be announced through the Platform before they take effect. Your continued use of the Platform after the changes take effect constitutes your acceptance of the updated Terms.
